This Website Privacy Policy (the “Policy”) describes how King Features Syndicate, a division of Heart Holdings, Inc. (“King Features,” “we,” “our” or “us”) handles the personal information that it obtains through www.popeye.com (the “Site”), a U.S.-facing website, including how we can use this information and with whom we may share it.

This Policy applies only to information that King Features collects on or obtains through this Site and not to any information that we collect through other methods or our services, or to any information obtained by other companies.

WHAT PERSONAL INFORMATION DO WE OBTAIN?

Information You Provide – Depending on the features of the Site you use, you may choose to provide us with your information. For example, if you contact us by email, we may collect your name, contact information and any other information you may choose to provide to us when you contact us.

Social Media Widgets – The Site includes social media features and functions, such as Facebook, Instagram, Twitter and YouTube widgets. When you engage with these features and functions or interact with our Popeye social media pages, we may obtain information such as your username, demographic information and other information you share on or make public using the relevant social media platform (including pictures).  We obtain this information directly from the social media platform or through plug-ins, integrations or applications.  Please keep in mind that the operators of the social media platforms also collect information about you and your use of their platforms and features.  We are not responsible for the privacy practices of these social media platforms and we encourage you to review their privacy policies and the privacy settings they make available to you.

Information Automatically Collected About Your Visit – We may automatically receive certain information when you visit our Site, including through cookies and other technologies. A cookie is a small amount of data (often including a unique identifier), that is sent to your browser from a website’s computers and stored on your computer’s hard drive or mobile device. We may use cookies to administer the Site, understand Site usage and improve the content and offerings on our Site. We may also use cookies to collect aggregate information about Site users. The information collected for these purposes (including your IP address and other information collected by automated means) may be disclosed to or collected directly by our third-party web analytics service providers. This Site may contain links to third-party websites or features, including those provided by social media companies.  You acknowledge and agree that King Features is not responsible for the collection and use of your information by such third parties that are not under our control.  We encourage you to review the privacy policies applicable to third-party websites or features.

CHILDREN’S INFORMATION

The Site is not directed to, nor do we knowingly collect personal information from, children under the age of 13. If you become aware that your child or any child under your care has provided us with information without your consent, please contact us as indicated below.

DISPUTE RESOLUTION

PLEASE READ THIS CAREFULLY.  IT AFFECTS YOUR RIGHTS.

Except for your or our claims of infringement or misappropriation of the other party's patent, copyright, trademark, or trade secret, any and all disputes between you and King Features arising under or related in any way to this Site, must be resolved through binding arbitration as described in this section.  This agreement to arbitrate is intended to be interpreted broadly.   

YOU AGREE THAT BY ENTERING INTO THIS AGREEMENT, YOU AND KING FEATURES ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.  YOU AND KING FEATURES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.  ANY ARBITRATION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.

The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes of the American Arbitration Association ("AAA"), as modified by this section.  For any claim where the total amount of the award sought is $10,000 or less, the AAA, you and King Feature must abide by the following rules:  (a) the arbitration shall be conducted solely based on written submissions; and (b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties.  If the claim exceeds $10,000, the right to a hearing will be determined by the AAA rules, and the hearing (if any) must take place in New York, NY. The arbitrator's ruling is binding and may be entered as a judgment in any court of competent jurisdiction.  In the event this agreement to arbitrate is held unenforceable by a court, then the disputes that would otherwise have been arbitrated shall be exclusively brought in the state or federal courts located in New York City, New York. Claims of infringement or misappropriation of the other party's patent, copyright, trademark, or trade secret shall be exclusively brought in the state and federal courts located in New York City, New York.

This Policy shall be governed by and construed solely and exclusively in accordance with the laws of the State of New York, USA without giving effect to any law that would result in the application of the law of another jurisdiction.

CHANGES TO THIS POLICY

We may update periodically this Policy and without prior notice to you to reflect changes in our personal information practices. If we make material changes to this Policy, we will notify you by posting a new Policy on this page.
